EQUIPMENT RENTAL TERMS AND CONDITIONS
1.GENERAL TERMS
A) These Terms and Conditions set out the terms of use of the equipment rental service offered by Wordfall Dominik Lisiakiewicz, NIP 6423019122, based at Szczygłów 30, 44-200 Rybnik ("Company").
B) The Hirer's consent to these Terms and Conditions is given by the act of renting an equipment from the Company. In the event of any discrepancy between the rental agreement (hereinafter referred to as the "agreement") and the Terms and Conditions, the parties shall be bound by the agreement.
C) The Hirer must be a minimum of 18 years of age and present a valid identification document, a payment card in their name, and a booking confirmation/voucher at the time of equipment collection.
D) The Company maintains the right to deny hire to any individual considered high-risk.
E) The equipment may be operated exclusively by the Hirer or an operator specified in the contract (the Hirer is obliged to declare an operator at the time of contract signing).
F) The proof of equipment handover is a delivery and acceptance protocol, signed by both parties.
G) The hired equipment should not be used by the Hirer or third parties in a way that contradicts its intended purpose, specifically for any illegal activities, against the manufacturer's operating instructions, or in conditions that could cause damage to the equipment.
H) It's not permitted to remove or conceal any equipment markings, including those of the Company, unless the Company provides written consent.
I) The Company retains the right to terminate the rental contract without prior notice, reimbursing the deposit and immediately retrieve the equipment at the expense of the Hirer, if the Hirer uses the equipment in a manner inconsistent with the Agreement, these Terms and Conditions, or by Polish law regulations.
2.RESERVATIONS AND CANCELING
A) Reservations can be made online, over the phone, or in-person at any of the Company’s offices.
B) Reservations must be made at least 24 hours in advance.
C) The act of making a reservation through the online system does not equate to its acceptance. The reservation is considered accepted at the moment of confirmation by a Company employee via an appropriate email.
D) The Company reserves the right to refuse equipment rental in the event that the customer provides false personal information when making a reservation.
E) In the event of failure to pick up the equipment according to the time specified in the reservation and not informing a rental employee about a change in the pick-up time, the rental company reserves the right to cancel the reservation.
3.INSURANCE AND DAMAGES
A) All equipment comes with a basic insurance coverage. In case of damage or theft of the rented equipment, the Hirer's own contribution is required. Additional insurance to eliminate the excess in case of damage can be purchased.
B) Any damages to the equipment during the rental period not covered by insurance will be charged to the Hirer.
C) In circumstances where the Renter causes intentional damage to the equipment or fails to adequately secure the equipment (such as leaving the equipment unattended), the Renter is fully or partially responsible for covering the resultant damage.
D) The insurance does not absolve the user from liability for misuse of the equipment and resulting damages.
4. EQUIPMENT RETURN
A) The Hirer is obligated to return the equipment to the agreed location, at the agreed time, and in the same condition as at the start of the rental period.
B) Failure to return the equipment at the agreed time may incur additional charges.
5.ALTERATIONS TO THE EQUIPMENT
A) No alterations to the equipment are allowed without prior written consent from the Company.
6.FEES AND PENALTIES:
A) Unauthorized equipment provision – 300 EUR
B) Return of damaged equipment - repair cost + 250 EUR.
C) Loss of equipment - requires covering the total cost of the missing equipment + 250 EUR.
D) Administrative fee for the late return of the equipment exceeding 60 min without informing the Company. – 20 EUR/hour
after 2 hours - an additional day's rent
Violation of these terms may result in immediate termination of rental and/or legal action.
EQUIPMENT SALE TERMS AND CONDITIONS
1. GENERAL PROVISIONS
A) This Regulation defines the rules for purchasing equipment offered by Wordfall Dominik Lisiakiewicz, VAT ID 6423019122, with its registered office at Szczygłów 30, 44-200 Rybnik, hereinafter referred to as the "Seller".
B) This Regulation is addressed to both consumers and entrepreneurs using the Online Store; making purchases in the store is equivalent to accepting the regulations.
2. CONDITIONS OF CONCLUSION OF SALES AGREEMENT
A) The conclusion of a Sales Agreement between the Customer and the Seller occurs upon the Customer placing an Order in the Online Store.
B) Upon placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for processing. This confirmation will be sent to the Customer via email to the address provided by them, containing statements from the Seller regarding the acceptance of the Order and confirmation of the conclusion of the Sales Agreement. Receipt of this email by the Customer will signify the official conclusion of the Sales Agreement between the Parties.
3. COMPLAINTS AND RETURNS
A) The Customer has the right to complain about a product that has physical defects. Complaints must be reported electronically, and the seller has 14 days to respond to them.
B) If the complaint is positively reviewed, the customer is obliged to return the goods to the seller. Upon receiving the defective goods, the seller has 5 days to dispatch the replacement goods.
C) The Customer also has the right to withdraw from the contract within 30 days of receiving the product if it does not meet their expectations. The seller is obligated to refund the money for the goods.
4. DEFINITIONS
A) SALES AGREEMENT – a sales agreement for the Product concluded or to be concluded between the Customer and the Seller through the Online Store.
B) BUSINESS DAY – one day from Monday to Friday excluding statutory holidays.
C) CUSTOMER – person with full legal capacity, and in cases provided for by applicable law, also a natural person with limited legal capacity; (2) a legal person; or (3) an organizational unit without legal personality, which has legal capacity granted by law; - who has entered into or intends to enter into a Sales Agreement with the Seller.
D) PRODUCT – a movable item available in the Online Store that is the subject of the Sales Agreement between the Customer and the Seller.
